In order to encourage and guide enterprises to effectively carry out clean production, standardize the clean production audit acceptance procedures, according to "Cleaner Production Promotion Law of the People's Republic of China" and "Cleaner Production Audit in Anhui Province Interim Measures", the development of this approach.
Article II of these measures apply to the acceptance of clean production audit activities within the jurisdiction of the province of various types of enterprises.
Article III of these measures refers to the clean production acceptance of enterprises to carry out clean production audits, the preparation of audit reports, and through the implementation of the program to achieve a certain performance stage review.
Article IV of the Provincial Commission with the Provincial Environmental Protection Bureau to organize the province's clean production audit, acceptance, responsible for the province's enterprise clean production audit acceptance of the organization, management, announcement and other work. Anhui Provincial Cleaner Production Center commissioned by the Provincial Economic Commission, the Provincial Environmental Protection Bureau, is responsible for the provincial key enterprises clean production audit acceptance of the initial review, and the organization of acceptance expert group responsible for the assessment of clean production audits. Acceptance of clean production in other enterprises, under the guidance of the provincial Cleaner Production Center, by the municipal Commission, Environmental Protection Bureau is responsible.
Municipalities should encourage enterprises to voluntarily carry out clean production audits, and the voluntary clean production audits of enterprises for acceptance.
Chapter II clean production enterprise acceptance of the basic conditions
Article V application for clean production audit acceptance of enterprises must have the following conditions.
(A) in line with the "Cleaner Production Promotion Law of the People's Republic of China" and related laws and regulations.
(B) to complete the clean production audit process and achieve significant performance.
1, in investment, technological innovation, production process organization, product packaging and other aspects of the use of national and provincial announcements of clean production processes and technologies, or the development of clean products, research and development of new technologies and new processes of clean production, in reducing the waste of resources and energy, prevention and control of environmental pollution is effective.
2, cleaner production programs and the whole process of pollution control measures should meet the local environmental protection departments of the enterprise to meet the standard emissions and total control requirements.
3, the state explicitly ordered the elimination of the main processes and equipment situation is clear, and there is a phase-out time frame.
4, no / low cost program more than 90% implementation, medium / high cost program at least 1 implementation. After the completion of the program implementation of energy consumption indicators, material consumption indicators, pollutant emissions indicators significantly reduced. Among the first clean production audit enterprises, energy consumption indicators must be reduced by more than 20% or the total reduction of pollutant emissions must reach more than 10%.
5, transformation, updating serious pollution, backward technology production processes and equipment after the economic benefits, environmental benefits are obvious.
(C) the enterprise has set up a sound cleaner production work agencies.
(D) the audit process organized cleaner production training, and training records.
(E) the establishment of cleaner production rules and regulations and incentives.
Chapter III acceptance procedures
Article VI application for acceptance of the enterprise will be the enterprise clean production summary report, clean production audit report, "Cleaner production in Anhui Province, the implementation of enterprise table" (Table 1, Table 2) submitted to the Provincial Cleaner Production Center pre-screening. After the pre-screening, the application for acceptance of enterprises formally to the organization responsible for acceptance of the Commission and the Environmental Protection Bureau to submit an application for acceptance. For mandatory cleaner production audits of enterprises, there must be a preliminary opinion of the environmental protection department of the enterprise location.
Article VII of the proposed acceptance of enterprises, 15 days before the acceptance, the cities will be accepted by the enterprise clean production summary report, "Cleaner Production in Anhui Province, the implementation of enterprise tables" (Table 1, Table 2), the acceptance of the list of experts to the Provincial Economic Commission, the Provincial Environmental Protection Bureau each a copy.
For mandatory cleaner production audit enterprises, can not apply for acceptance according to the required time limit, can be submitted to the Provincial Environmental Protection Bureau to extend the application for acceptance, after approval before extending the acceptance.
Article VIII of the inclusion of key provincial enterprises acceptance, in principle, entrusted to the municipal organizations, the province assigned experts to participate in the acceptance; the province will focus on the proportion of 10 to 20% of the selected individual key enterprises to organize acceptance. Acceptance of enterprises not belonging to the provincial key, organized by the municipalities. The province will from time to time participate in the acceptance of the municipalities or acceptance of the municipalities to conduct random checks.
Article IX of the Municipal Economic Commission, Environmental Protection Bureau received the application materials for acceptance of enterprises, to organize a group of experts to conduct on-site acceptance of enterprises. The expert group should be familiar with environmental protection, energy, industry, clean production members.
The cities should be 10 days before the acceptance, the acceptance of the enterprise clean production audit report, "Cleaner production in Anhui Province, the implementation of the enterprise table" (Table 1, Table 2) sent to the acceptance experts.
Article X acceptance process
(A) the leadership of the enterprise in charge of clean production to introduce the basic situation, clean production process, clean production results, experience and the intention of sustainable clean production.
(B) clean production audit report preparation unit or audit consulting agency to introduce the analysis of the current situation of enterprise products and energy and resource consumption, analysis of the current situation of production and emissions, audit focus and target indicators, assessment process, medium/high cost cleaner production program, cleaner production performance, the medium/high cost cleaner production program to explain the proposed time and implementation time.
(C) the expert group site visits, the main content of the medium / high cost program, no / low cost program implementation, on-site questioning of enterprise personnel on the understanding of cleaner production and work carried out, view the production site, energy and quality inspection and measuring instruments, processes and pollution control facilities operation, verification of enterprise energy consumption, pollutant emissions records, environmental monitoring reports, cleaner production training records, the Technical transformation witness materials, etc.
(D) according to the results of site visits and enterprise cleaner production audit report, by the expert group according to the "Anhui Province Cleaner Production Audit Review Score Sheet" on enterprise cleaner production audit work for scoring, evaluation, and the formation of evaluation comments. Assessment results are divided into "qualified", "basic qualified", "unqualified" three.
Article XI through the acceptance of enterprises, by the Provincial Economic Commission, the Provincial Environmental Protection Bureau comprehensive assessment of merit awarded the "Cleaner Production in Anhui Province stage results of enterprises" title, and in the relevant media for announcement. For the assessment of qualified, recommended to participate in the Anhui Province advanced enterprise assessment of clean production.
Article XII for the acceptance of unqualified enterprises, audit institutions, enterprises should be within 3-6 months, and seriously do a good job of rectification work. After the completion of the rectification, the audit report and rectification report reported to the Anhui Provincial Cleaner Production Center, the expert group to review and approve before the acceptance. For the acceptance of unqualified enterprises, audit institutions, enterprises should be based on the acceptance meeting review requirements, in 3-6 months to do a good job of rectification work. After the completion of the rectification, the audit report and rectification report will be reported to the acceptance organization department and the provincial cleaner production center and acceptance expert group, the expert group review, approval, the cities to confirm before acceptance.
For the acceptance of enterprises, audit institutions, enterprises should be based on the acceptance meeting review requirements, make changes to the text and related work, and the revised audit report reported to the provincial and municipal economic and environmental protection bureau and the Anhui Provincial Cleaner Production Center.
Article XIII of the following circumstances, assessed as unqualified, not through the acceptance.
(A) the audit focus on setting the wrong or audit focus on major omissions.
(B) did not do a comprehensive analysis of the scope of this audit of the potential for cleaner production.
(C) there are major errors in the data.
(D) did not invite the necessary environmental experts, energy experts, industry experts as needed, resulting in a large audit deficiencies.
(E) enterprise falsification.
(F) enterprise organization and implementation of cleaner production program is clearly not in place.
Chapter IV Supervision and management
Article XIV of the Provincial Economic Commission, the Provincial Environmental Protection Bureau every two years to supervise and inspect the clean production acceptance of enterprises. After inspection does not meet the requirements, the withdrawal of its "cleaner production stage results of enterprises" title, and be announced. Enterprises need to re-examine and accept the clean production.
Article 15 Any unit and individual has the right to the relevant departments to report, expose fraudulent behavior. Once found that the enterprise has exceeded the standard emissions and other illegal acts, continue to use the main processes and equipment eliminated by the state does not rectify the requirements, energy and water consumption and other indicators seriously exceed the national standards, revoke the "Cleaner Production Stage Achievement Enterprise" title, and according to the "Cleaner Production Promotion Law of the People's Republic of China" to be punished, and at the same time in the News media to be announced.
Article XVI of the Economic Commission at all levels and the competent administrative departments of environmental protection and technical service agencies shall implement clean production audit of enterprises to conserve technical secrets.
Chapter V By-laws
Article XVII of these measures by the provincial economic commission and the provincial environmental protection bureau is responsible for the interpretation.
Article 18 These measures shall come into force on October 1, 2007.
